Privacy Policy & Cookies

This policy applies to the processing of your details by Rescapo®, which may or may not be available on our website at https://www.rescapo.com. With this policy, we try to inform you about this in a transparent way. We advise you to read this policy carefully. You can consult this policy at any time under the heading 'Privacy Policy' on our website.

For questions or requests, you can always email to hello@rescapo.com. We may change this privacy policy at any time. You should, therefore, consult it on a regular basis. The amended privacy policy will be published on our website. This privacy policy is subject to Belgian law. Only the courts of Bruges (Bruges division(s)) have jurisdiction in case of disputes.

2. Who is responsible for processing your data?

We (Rescapo®) are. We are the so-called 'data controller' to use a difficult term. This means that we determine the purpose and means of processing and guarantee the lawful and correct processing of your data.

3. What data do we process about you and how?

3.1. Rescapo® processes the following data:

- your personal identification details: surname, first name, address, telephone number, e-mail address;
- if you are a company: name of the company, registered office and company number;
- your financial details: bank account number and/or other payment details;
- electronic identification and location information when you visit our website: device information, browser, operating system, IP addresses, cookies, log file data, external websites that have referred you, pages you visited on the website (and date and time);
- personal characteristics if needed (e.g. for personalised cards with orders): e.g. age, date of birth and gender.

3.2. Rescapo® may receive and process your personal data in the context of the contract with you, when you place an order or have a delivery carried out, when you contact Rescapo® for information (by telephone, in writing, or through the website), or by cookies on our website.

4. Why and on what basis do we process your data?

4.1. Rescapo® processes your personal data for the following purposes:

Customer management:

We process your personal data to contact you, handle any questions you may have and provide you with the necessary information about our products, our services, special offers, discounts, our website, or other information related to our activities. We also process your personal data for the management of our customer records, the execution and follow-up of orders, deliveries, collections, payments, administration, invoicing, and accounting.

We process your data in the context of the execution of the contract with you as our customer.

The processing of your data for these purposes is necessary for the preparation and execution of the contract.

If you do not provide us with certain details, such as your identification details or financial details, which we require for the purposes of the contract, either directly or through the ordering platforms we work with, we will not be able to serve you, or process or execute your order(s). We may process your data to optimize sales and our products and services. For example, Rescapo® may contact you to place a review on our website. This can be done on the basis of our legitimate interests.

Direct marketing:

Your data may be used for direct marketing. This means sending information via our newsletter or other means about our products and services or other information that could be interesting or useful to you.

If you are a customer, this can be done on the basis of our legitimate interests. If you are not a customer, we need your prior consent (e.g. by registering on our website). Your consent is free and can be withdrawn at any time.

Ensuring the optimal functioning of our website:

When you visit or consult the website, we may process certain electronic data, such as cookies and IP address. Cookies facilitate interaction between you as a visitor and our website and are used to improve the user experience and to collect statistics among visitors to our website. Cookies also ensure that your personal settings and preferences are stored or that audio and video material can be played back. Certain cookies may be placed by a third party, e.g. Google Analytics, to measure the use of our website. More information on the use of cookies can be found in our cookie policy.

Compliance with applicable laws:

The processing of your data, whether or not on or through the website, is not done for the purposes of 'automated individual decision-making' or profiling.

5. Who else receives or processes your data (besides Rescapo®)?

5.1. Your data are also primarily processed by our partners, service providers, or suppliers with which we collaborate. Furthermore, our website administrators, IT partners, and network operators may also process your data in connection with your visit and use of our website. Companies that provide payment services, marketing services, or analytical services to Rescapo® may also process your data in this context.

5.2. Finally, other companies may also process your data in the context of our activities, such as our bookkeepers, accountants, auditors, insurance brokers, insurance companies, legal advisors, or other service providers.

5.3. We are not responsible for the processing of your data by third parties who do not do this on behalf of Rescapo®, but are themselves responsible for this (e.g. the ordering platforms we work with).

5.4. Rescapo® may be obliged to provide or process your details on the basis of a legal obligation incumbent upon it and/or in response to a request to this effect from supervisory authorities or government agencies.

6. How long do we keep your data?

6.1. We will not retain your data for longer than is necessary for the purposes described in article 5 above, unless special legal provisions apply to their retention or processing.

6.2. For example, we will retain your data for the purposes of online sales or sales through our collection points for a maximum of 10 years after the (last) order or delivery (this is the limitation period for contractual claims). Other time limits apply for certain other data. For example, we will keep certain social security documents relating to staff for five years and certain accounting and tax documents for seven years. We will retain data of job applicants for up to three years after their application, unless we need the data to defend ourselves against possible claims (e.g. concerning discrimination in the recruitment process) in which case we may keep the data for up to five years.

Certain other data may also be subject to specific legal retention periods. In any case, the principle applies here that we do not keep your data longer than necessary.

7. What are your rights?

7.1. You have the right to information about the processing of your

 data. This will be communicated to you in this privacy policy. You may also ask us to provide additional information at any time.

7.2. You have the right to ask us for:
- access to your data.
You can get one copy of the requested information free of charge. If you request additional copies, we may charge you a reasonable fee to cover the administrative cost.
- rectification of your data (if necessary);
- deletion of your personal data if:
    - the processing of those data is no longer necessary for the purpose or purposes for which they were processed by us;
    - you have withdrawn a previously given consent;
    - you object to our processing;
    - the personal data may have been processed unlawfully by us;
    - this is necessary to comply with a legal obligation; or
    - the personal data may have been processed in connection with the provision of online services to children.
- limitation of the processing that relates to you.
You have the right to obtain a limitation of the processing if:
    - you dispute the accuracy of the data at our disposal;
    - the processing is unlawful and you oppose the deletion of the personal data and instead request the restriction of their use;
    - we no longer need those data whereas you still need them for the institution, exercise or substantiation of legal claims; or
    - pending an answer to the question of whether Rescapo®'s legitimate grounds outweigh yours or your (privacy) rights if you have objected to the processing on the grounds of our legitimate interest.

7.3. You have the right to object to the processing of your data.

You may at any time and free of charge object to the processing of your data for direct marketing purposes. You can do this simply by letting us know at privacy@rescapo.com and/or by unsubscribing from our website. This can also be done through the mailings themselves (at the bottom there is always the option to unsubscribe). You will then no longer receive newsletters from us.

7.4. You have the right to portability of your data (to another data controller). This is only possible if the processing by us is based on your consent or if the processing is carried out using automated processes.

7.5. If the processing of your personal data is based on your consent, you have the right to withdraw your consent at any time.

7.6. You also have the right to complain to the Data Protection Authority (rue de la Press 35, 1000 Brussels - T: +32(0)2 274 48 00 - E: contact@apd-gba.be). In the event of a complaint, you may always contact Rescapo® directly: hello@rescapo.com

7.7. The exercise of your rights as set out above is always subject to the requirements and conditions set out in the applicable law (such as the General Data Protection Regulation (the 'GDPR')).

7.8. To exercise your rights, you can simply send a request to Rescapo® at hello@rescapo.com. In doing so, you must identify yourself sufficiently. If we have reason to doubt your identity, we may ask you for additional information to confirm your identity. We will usually ask for a copy of your identity card to verify who is actually making a request.

1.2 This cookie policy informs you about the use and purpose of cookies on our website. This policy is made available to you electronically and can be consulted at any time under the heading 'Cookie Policy' on our website. We reserve the right to change this cookie policy at any time. Changes will be announced on the website.

2. What are cookies and what are they for?

2.1. Cookies are small data files that are stored by the browser on the hard drive of your computer or device when you visit and/or consult a website or use a (mobile) application that stores certain user information. Cookie files contain unique codes that, for example, allow your browser to recognise you when you visit the website and thus improve your user experience. Cookies facilitate interaction between the visitor and a website and are used to improve the user experience and to collect statistics among website visitors. Cookies also ensure that your personal settings and preferences are stored or that audio and video material can be played back. Certain cookies may be placed by a third party, e.g. Google Analytics, to measure the use of a website.

2.2. Cookies can, among other things, help us to improve your experience with our website and to ensure that it performs optimally as you expect. For example, we may improve your experience of using a website, for example by tracking your use of our website, so that it can be improved to meet your needs. We can also ensure that advertisements you see online are more relevant to you and your interests.

3. Enabling and disabling - managing cookies

3.1. You can change your preferences via your browser at any time by following the instructions at the links below, depending on your browser: Internet Explorer, Firefox , Chrome, Safari, iOS.

3.2. The use of cookies may be disabled. Your browser allows you to delete cookies automatically or manually and allows you to specify whether or not certain cookies may be placed. You can also set your browser to notify you when a cookie is placed.

If you disable cookies, however, it may happen that the website will no longer function properly or that certain (graphic) elements or applications on the website will function less well or cease to function.

4. Consent

4.1. Your consent is required for the placement and consultation of cookies via the website on your terminal equipment, unless it concerns the technical storage of information or the provision of a service expressly requested by you when the placement of a cookie is strictly necessary for this purpose.

Therefore, your consent is not required for functional or essential cookies.

However, your consent is required for non-functional or non-essential cookies. Your consent must be:
obtained before the cookies are placed. If your consent is not given, no cookies may be placed;
informed, which is why we inform you about the different cookies in this policy;
express and active. Your permission will therefore be obtained by ticking the boxes in the cookie banner on our website;
specific and therefore obtained per cookie or per category of cookies.

4.2. Functional or essential cookies are necessary for the optimal functioning of our website, to display certain graphical elements, etc. These cookies are technically necessary for the proper functioning and security of the website. These cookies are therefore placed without your consent as they are in the legitimate interest of Rescapo®.

On the other hand, non-functional or non-essential cookies are placed for statistical, social and/or commercial purposes and are not connected with the technical support of our website. They are, for example, the following cookies:

Analytical cookies: these cookies are used to compile statistics on the number of visitors to the website, the most popular web pages, etc. (e.g. Google Analytics - see below). These cookies show how the website is used. For example, Rescapo® knows how many times a particular page is read, how much time someone spends on our website, etc. Statistical analyses are made of the information we receive in this way. Thanks to these statistical results, we can improve the structure, navigation and content of our website and related services. We also use these data for general reporting on our services or in the context of surveys in which we participate. No personal data are passed on in the process. The consent of each visitor is required for the placement of these cookies.

Marketing cookies: these cookies are used to personalise online advertising offers.

Social media cookies: these cookies make it possible to include buttons from social networking sites. The buttons work by a code originating from these sites. A handy tool to promote web pages such as 'like' and 'pins'.

4.3. If you have given your consent to the use of non-functional cookies on our website, you can change this setting at any time and withdraw your consent. Any cookies already installed will then be deleted. You can do this here.

You can withdraw your consent to our cookies at any time, even if you have previously given your consent. However, please remember that if you do not consent to some of our cookies, the user experience may suffer.

5. Third party cookies

5.1. Our website uses its own cookies (first party cookies) which are placed directly by our website, as well as cookies from third parties whose services are or may be used on the website (third party cookies) and which are placed by a domain that is different from the domain of our website. This is also indicated in the second column of the table under article 6.2 below.

5.2. First party cookies do not presuppose a transfer of personal data to third parties but may use a third party processor, e.g. to compile statistics. Your consent is also required for the placement of e.g. first party analytical cookies.

5.3. Third party cookies make it possible for personal data to be sent to third parties either directly (e.g. by an active component linked to a banner or a spy pixel) or indirectly by placing cookies that are accessible to websites other than that of the advertiser.

For example, we use Google Analytics to collect information about how you use our website. We use the information to compile reports and to help us improve the website.
Among other things, Google Analytics stores information about:
the pages you visit;
the time you spend on each page;
how you got to the site;
what you click on while visiting the site.

These securely stored cookies do not collect information that identifies a visitor. All information collected by these cookies is completely anonymous. We only use such information to improve our website. If you do not want Google Analytics to keep track of all websites, please visit: tools.google.com/dlpage/gaoptout.

6. The cookies on our website

6.1. The table below shows which cookies we use on our website, why we use them and where they come from. We also indicate whether a cookie is a 'permanent' or 'session' cookie. The difference is as follows:

Permanent cookies remain on your device between browser sessions. They are activated each time you visit the website that created this particular cookie. For example, if a 'permanent cookie' is used on a

 website to remember your preferred language, you don't have to choose that language each time you visit that website.

Session cookies allow us to link a user's actions during a browser session. A browser session starts when you open the browser window and ends when you close the browser window. Session cookies are created temporarily. Once you close the browser, all session cookies are deleted.

6.2. The following cookies are or may be used on our website:
